Is Representation Expensive?

disability lawyer feeIf you are applying for Social Security Disability Insurance or Supplemental Security Income, you are likely aware of how long and confusing the process can be.  It has been shown that hiring representation can help individuals get through the process much easier and faster than doing so on their own.

However, generally speaking, individuals who are applying for these disability benefits are not sitting on a pile of cash – in fact, if you do happen to have a lot of money stored away, it’s likely that your claim for benefits will be denied based on that.  If you are considering representation for your Social Security Disability Insurance or Supplemental Security Income case, you are also probably wondering (and possibly worrying) about the costs involved.

The Law

Federal law governs the fees that representatives, such as disability attorneys, can charge for disability representation.  Currently, the Social Security Administration has set the percentage of fees to 25% of the retroactive dollar amount awarded the applicant, and this amount may not exceed 6000 dollars.  In the event that the Social Security Disability Insurance or Supplemental Security Income application goes through quickly and does not receive a retroactive award, the Social Security Administration will then review and approve the fee that the representative will charge.

If you do not receive benefits, the representative does not charge a fee.  Whether you hire representation or not is up to you, but these are the parameters for payment – most applicants who end up grappling with the process for an extended period of time do find that the representation is worth the fee.
