Can A Representative Decline My Case?

disability lawyer If you are applying for Social Security Disability Insurance or Supplemental Security Income, it’s important to be aware of representation and how much it might be able to help you win your case.  You can apply for benefits alone, as well, and many applicants do find success without the help of a third party.  However, it has been shown that nearly 90% of all applicants who end up having to go through the process of appeal do hire representation, such as a disability lawyer.  It is also true that having representation does up your overall chance of being approved for benefits in a timely manner.

It is also good to be aware of the parameters of representation, and what to do if you end up trying to find representation and are declined.

Representatives and Declining Cases

Of course, a representative has the right to decline to represent your case.  If this ends up happening to you, you might want to sit back and review your overall application.  Representatives do not get paid if they end up losing your case, so the only reason why a representative would really turn you down is if they feel your case is not strong enough to be won.

For Social Security Disability Insurance in particular, typical reasons for representatives refusing cases involve the applicant’s disability not being severe enough, or proof that the applicant did not spend enough time in the workforce to merit receiving Social Security Disability Insurance.  In the event that a representative declines your case for the second reason, check into applying for Supplemental Security Income instead – your chances may be better.
