The Four Different Types of Appeal: District Court Case

disability appealThe appeals process for Social Security Disability Insurance or Supplemental Security Income can be a very long and onerous process. Depending on where you live in the country, getting through the appeals process can take up to two years. This is a long time to have spent in the system. If you have been going through the appeals system for while and have been consistently denied, the very last step that you can take is called the district court case.

What Is the District Court Case?

The District Court case is the final level of appeals for either Social Security Disability Insurance or Supplemental Security Income. At this point in the process, you must have representation in the form of an attorney. This is because you have made the decision to take your disability insurance case to court. Essentially you are filing a court case against Social Security due to their consistent denials of your application for disability insurance.

When you get to District Court case level, your case will be heard by a District Court judge. The judge will notify you in writing of his/her decision regarding your case when it is made.

When you get to this level of appeal, you are at the very end of the process. If your claim for disability still gets denied after the District Court case, you will likely need to reapply for disability insurance, if you are still interested in pursuing it. However, generally speaking, if you are denied at the district court case level, it is highly unlikely that your application for disability insurance will be considered further, even if you do reapply.
