If I Am Denied, What Do I Do?
Posted in: Application Process on August 12th, 2011

The first step in rebounding from a denial when it comes to either Social Security Disability Insurance or Supplemental Security Income is not to panic.  Many people get denied on their initial attempt to get benefits from either one of these programs, so just because you don’t get through the first time doesn’t mean that you will be forever banned.

disability benefits deniedShould I File A New Application?

No.  This is one of the biggest mistakes that individuals make when they are in the process of dealing with a denial.  If you make an entirely new application, you’ll find that the process will take even longer, as it will be registered that you have two applications in the system.  What you need to do is file a Request for Reconsideration.  You can either do this yourself or have a disability lawyer do it for you.

What this does is begin the process of appeal.  An appeal is when you take your initial case back to court and have the judges look at it again.  Don’t feel discouraged – nationally, almost half of all benefits awarded through either Social Security Disability Insurance or Supplemental Security Income is through the process of appeal.  So if you get denied the first time you might be disappointed, but at least you will be in good company!

Denial is not the end of the claims process.  It can be a frustrating thing to deal with and it does mean an increase in paperwork and time, but you can still get your benefits.
