How Do They Decide?

benefits approved vs deniedIf you or somebody you know is applying for Social Security Disability Insurance, one of the forefront question of your mind is exactly how they decide who receives the payments or not.  The short question to this is that it really does depend: studies have shown that different judges have different ideas on how liberal they should be with handing out disability payments.  Depending on what judge you get or where you live, you might find it very easy or extraordinarily difficult to get benefits.

What are the criteria?

In a general sense, the judge will consider your application based on your medical documentation, age, and work history.

The state of your current working status is also important.  As of 2011, if you make more than 1,000 dollars a month outside of disability insurance, you are not eligible to receive payments.  You also must have been paying FICA taxes for a certain amount of time in order to be considered eligible for the program.  In the event that you have never been able to work and thus pay taxes into the system, you should apply for Supplemental Security Income, or the branch of social security meant for those who have never worked due to illness or disability.

Keep in mind that appeals are available if you get denied.  Over two-thirds of all applicants for Social Security Disability Insurance are denied on the first go around.  Remember never to give up – you have to be in it for the long haul if you want it to work!
