Applied and Denied?

social security benefits deniedFirst of all, if your claim for Social Security Disability Insurance or Supplemental Security Income is denied at the “application level” – or when you initially get involved with the process – be aware that you are certainly not alone.  Nearly two thirds of all initial applications get denied their first time through the system.  The average amount of days for disability benefits to be awarded is 500 – and while that might seem daunting, remember that for some it takes even longer!

What Happens After?

After you have been denied, you will have the right to file an appeal to combat the denial.  At this point, many people decide to go with the help of a disability lawyer to bolster their application.  Whether or not you decide to hire a lawyer is up to you, but be aware of the costs that are involved with such a move.  There is no requirement to have a lawyer at any part during the process, though having one will likely shorten your appeals time.

The second disability appeal is known as a “hearing level,” and this is where your case will be brought to court.  Be sure to do plenty of research on what will happen at this hearing (or have your lawyer do it for you) to be able to represent yourself well at the hearing.  If the claim gets rejected again, you go back to the appeals board.  And if you still need the payments, that’s when you try again!
